Terms of Service
Effective August 27, 2026. Operated by Kinetic Helix LLC, a Florida limited liability company (doing business as “Sealed Rose,” “we,” “us,” “our,” or the “Company”).
These Terms of Service (“Terms”) govern access to and use of Sealed Rose’s website, apps, and messaging/calling services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance & eligibility
You must be at least 18 years old to use the Service in any capacity. Identity and age verification is mandatory: before you can send or receive paid messages or calls, you must complete verification through our partner (Persona). Creators additionally undergo enhanced identity verification consistent with federal recordkeeping law. We do not store your government ID ourselves; our verification partner retains what the law requires, as described in our Privacy Policy. The Service is offered for use within the United States only; a VPN/proxy signal alone flags an account for review but does not by itself block you. Accounts are personal to the verified individual and may not be transferred, sold, or assigned.
2. The Service
Sealed Rose is a venue that enables verified adult buyers and verified adult creators to communicate through paid, one-to-one text messaging and paid, one-to-one voice/video calls, priced per message and per call minute using Credits (Section 4). Sealed Rose is not an escort, dating, or in-person-meeting service, and does not arrange, broker, advertise, or facilitate in-person meetings; nothing paid for through the Service entitles any user to an in-person encounter. The Service offers no city or location-based browsing and uses no “incall”/“outcall” terminology. We use automated and human review to detect violations of Section 5 and act on them — never by silently editing a user’s content.
3. Accounts & security
Creator accounts must enable two-factor authentication; buyers are strongly encouraged to. No account sharing: you may not let anyone else access or operate your account, including a manager, agency, or “chatter.” Because a third party with account access can send messages, accept payments, or violate these Terms, Sealed Rose treats such conduct as the account holder’s own for enforcement, billing, and liability, regardless of who typed the message. A creator who wishes to use assistance must disclose it to us in writing and remains fully responsible for all activity; undisclosed account sharing is itself a violation. You are responsible for your credentials; notify us at [email protected] if you suspect unauthorized access. We may suspend access without prior notice to prevent fraud or harm.
4. Credits & payments
- How Credits work. Buyers purchase Credits with a payment card and spend them on priced messages and on call minutes ($9.00/minute). Prices are set per creator and/or action and shown before you spend.
- Credits never expire and do not lose value with account inactivity, subject to the dormancy/unclaimed-property disclosure in our Refund & Credits Policy (state law may independently require reporting long-dormant balances; that does not cause expiration under these Terms).
- Refundable any time. Buyers may request a refund of unspent Credits at any time. Refunds and cash-outs are always processed as a reversal of the original charge, back to the original payment instrument — never as a new payment to a bank account, wallet, or check. If the original instrument can no longer accept a reversal (expired/closed card), our Refund & Credits Policy governs.
- Automatic 24-hour no-reply return. If a creator does not reply to a paid message within 24 hours of delivery, the Credits spent are automatically returned to the buyer’s balance as Credits — never as a cash payment, and the creator is not paid for the unanswered message.
- Daily top-up limit. Credit purchases are subject to a daily cap of $2,000 per buyer across all payment methods, and may be set lower for newly verified accounts or accounts under review.
- Credits are a prepaid balance for messaging and calling services, redeemable only within Sealed Rose — not currency, a deposit account, a security, or a general-purpose stored-value product.
- Limited payment-collection agency. When you pay for a message or call minute, Sealed Rose acts solely as the creator’s limited agent for collecting that payment; payment to Sealed Rose discharges your obligation to the creator. This agency is limited to payment collection.
- Creator payout. Creators receive 80% of Credits successfully spent on their messages and calls (20% platform fee), paid out weekly once the payable balance reaches $20; below-threshold balances roll forward. Creator payout mechanics are governed by the separate Creator Agreement.
- Cash-out on account close. A buyer’s remaining balance can be cashed out only on account closure, and only as a reversal to the original payment instrument(s).
- Payment processing. Payments are processed by third-party processors and are also subject to their terms; we are not responsible for processor outages or declines outside our control.
5. Prohibited conduct
You agree not to use the Service to:
- Solicit, arrange, or facilitate an in-person meeting, or offer, request, or discuss payment for an in-person sexual act or encounter of any kind, on- or off-platform.
- Circumvent on-platform payment, including moving payment off-platform to avoid our fee or verification/safety controls.
- Post, send, or possess child sexual abuse material (CSAM) or content that sexualizes minors in any way, including simulated, illustrated, or “aged-up” depictions. We report suspected violations to NCMEC and other authorities as required by law.
- Post or share non-consensual intimate imagery (NCII), or threaten to expose it.
- Harass, threaten, stalk, dox, or abuse another user or third party.
- Impersonate any person or entity, or misrepresent your identity, age, or affiliation.
- Circumvent verification or moderation systems, including using another’s identity, creating multiple accounts to evade a ban, or using a VPN/proxy specifically to defeat screening.
- Violate any applicable law, these Terms, our Community Guidelines, or our DMCA Policy.
Violations may result in content removal, warnings, suspension, permanent termination, forfeiture of pending creator earnings tied to the violation, and reporting to law enforcement or NCMEC where required.
6. Content & license
Buyer license — view-only, no downloads. Paying to view Content (including commissioned content) grants a limited, non-exclusive, non-transferable, revocable license to view that Content within the Service only. It does not include any right to download, save, screen-record, redistribute, or otherwise copy the Content, by any means. Sealed Rose uses streaming delivery and watermarking to support this; circumventing them violates Section 5 and potentially the law. Creator ownership: creators retain all ownership rights in Content they create; nothing here transfers ownership to Sealed Rose. Each creator grants Sealed Rose a non-exclusive, worldwide, royalty-free license to host, store, transmit, display, format, and watermark their Content solely to operate, secure, and protect the Service, ending when the creator deletes the Content or closes their account, except where retention is legally required.
7. Intellectual property & DMCA
Sealed Rose’s trademarks, logos, and software are owned by Sealed Rose. If you believe Content infringes your copyright, see our DMCA Policy for the designated agent and our notice-and-takedown procedure under 17 U.S.C. §512.
8. Disclaimers & limitation of liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Sealed Rose is not responsible for the conduct, statements, or Content of any user; interactions between buyers and creators are between those individuals, and Sealed Rose is not a party to them beyond providing the Service and the limited payment-collection agency in Section 4. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEALED ROSE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, AND OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID SEALED ROSE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain of these limitations, in which case they apply only to the extent permitted.
9. Dispute resolution
Informal resolution first. Before filing a claim, contact us at [email protected] and attempt to resolve the dispute informally. These Terms contain no mandatory arbitration clause and no class-action waiver; disputes not resolved informally may be brought in court. Governing law: these Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles, except to the extent a mandatory consumer-protection law of your state of residence applies notwithstanding this choice.
10. Changes to these Terms
We may update these Terms. For a material change we will provide notice (in-app or email) before it takes effect; continued use after that constitutes acceptance. If you do not agree, stop using the Service and may close your account under Section 12.
11. Related policies
These Terms incorporate by reference our Community Guidelines, Privacy Policy, and DMCA Policy, plus the Refund & Credits Policy and Creator Agreement. Where a more specific policy governs a matter, it controls for that matter.
12. Termination
You may close your account at any time. We may suspend or terminate your account, with or without notice, for violation of these Terms, our Community Guidelines, applicable law, or to protect the Service or others. On a buyer’s account closure, any remaining Credit balance is cashed out only as a reversal to the original payment instrument(s); where a portion cannot be reversed, our Refund & Credits Policy governs the fallback. Any earned, payable creator balance not yet paid out remains owed under the Creator Agreement, subject to amounts forfeited for violations. Sections on payment obligations, already-licensed Content, IP, disclaimers, and dispute resolution survive termination, and we retain records as legally required for the periods in our Privacy Policy.
